Cursing Smyrna woman awarded $85,000

A Smyrna woman is $85,000 richer after winning her three-year war of words with the city council.


So what was it that Mary Kirkendoll said that she wasn't supposed to have said in front of the Smyrna City Council?   "This is [expletive]," quoted her attorney, Cynthia Counts. That one word – the one we won't print here – violated a Smyrna law that prohibited cursing within earshot of women or children.

And that, said Counts, "is blatantly an unconstitutional statute."

But the city never admitted that, she said. Still, charges against Kirkendoll have been dismissed, the law has been repealed, and the town's insurance company has now settled for $85,000

"We hope that this is going to send a strong message and that it won't occur again," said Counts.
