A judge is refusing to throw out murder charges against Hemy Neuman.

Neuman is accused of gunning down Rusty Sneiderman, as Sneiderman dropped off his son at the Dunwoody Prep day care in late 2010.

Defense lawyers Tuesday peppered the judge with 15 motions, everything from too many case numbers on paperwork to whether the word "murder" can be used at the trial.

The judge granted only two.

"If that is allowed," defense lawyer Doug Peters argued, "I think it should be allowed for Mr. Neuman to be referred to as the Innocent Defendant."

The defense said Neuman had been improperly indicted for the murder; the prosecution said the defense was grabbing at straws.

Still unresolved is a motion to suppress testimony about the alleged murder weapon, a gun a witness says he sold Hemy Neuman.  Arguments on that are set for Monday.
