A judge rules to let a rape suspect go free in DeKalb County.

Roberto Gaona-Pina, 39, was arrested in May at a convenience store in Opelika, Alabama. His arrest came weeks after the alleged attack on Buford Highway at Cliff Valley Way in Brookhaven.

A woman said she was dragged into nearby woods, hit in the face and raped.

But a judge has ruled the woman told conflicting stories about what happened in the April attack.

And despite other accusers, the judge ruled there is not enough evidence to hold Gaona-Pina, who was extradited from Lee County, Ala. following his arrest.
