Douglas Co. jury unable to sentence beating suspect to death penalty

After several days of deliberation, a Douglas Coutny Jury is unable to reach a verdict in the sentencing phase of 20-year-old Tracen Franklin’s murder trial. This means that Franklin will not receive a death sentence for his part in the beating death of 18-year-old Bobby Tillman.
Last week the same jury convicted 20-year-old Tracen Franklin for murdering Tillman back in 2010, during a house party. Franklin and three other teens were accused of Tillman's death but, Franklin is the only one to seek a trial in the case.
Late Friday afternoon, a juror sent a note to the judge saying "the jury is gridlocked. We cannot come to a decision." Judge William McClain questioned the jury foreman about the panel's progress, then dismissed the jury.
WSB has learned the judge has schedule a sentencing hearing next Friday where he will decide whether or not Franklin will have the option of being sentenced to life in prison or granted parole in 30 years.
