The former DeKalb County police officer who shot and killed a naked military veteran appeared in court Friday morning.

Robert Olsen shot Anthony Hill in March 2015. Hill was naked and unarmed at an apartment complex in Chamblee.

Olsen's attorney wants the judge to drop the murder indictment against the former officer.

Defense attorney Don Samuel said the indictment was tainted because District Attorney Robert James had a number of office personnel in the grand jury room that shouldn't have been there. They said that violated courtroom secrecy.

Channel 2's Richard Elliot spoke to Hill's girlfriend about why she said it shouldn't make a difference about who was in the courtroom.

"He just went on a ramble talking about courtroom secrecy and prejudice and I just feel like how does court room secrecy really matter in a case where you murder a naked person," said Bridget Anderson.

The judge is expected to make a decision next week.

Hill's family says he was a U.S. Air Force veteran who struggled with mental health problems.
