The former teenager known for using an “affluenza” defense is set to be released from jail after testing positive for THC in a mandatory drug test.

Ethan Couch was jailed Thursday after the alleged probation violation.

Tarrant County District Attorney Sharen Wilson Couch says legal CBD oil could have caused the “weak positive” test result.

Couch is serving a 10-year probation for his role in a deadly crash in 2013 that killed four people. He was released from jail in April 2018, after serving time behind bars for violating his probation from his original conviction, CNN reported.

Couch's case made national headlines when a psychologist said that Couch, who was 16 years old at the time, suffered from "affluenza," or that he was a product of his affluent upbringing, paired with irresponsible parenting that "strongly enabled" the accident, according to ABC News.

Couch's blood-alcohol level three hours after the crash was three times the legal limit, despite being underage, CNN reported.

He was sentenced to probation, despite prosecutors asking for a 20-year jail sentence, CNN reported. Couch didn't check in with his probation officer in 2015. Instead, he and his mother fled to Mexico. A two-week manhunt ended with their arrest in Puerto Vallarta, ABC News reported.

Couch was then sentenced to 720 days in jail for probation violation, 180 days for each of the people killed in the crash, according to ABC News.

His mother Tonya Couch was charged with hindering the apprehension of a known felon and money laundering. She was released on bond and her case has still not been heard, ABC News reported.
