Snellville man challenges Gwinnett's trash plan

A Snellville man is hoping the Georgia Supreme Court will toss out Gwinnett County’s trash plan.

Currently property owners pay a fee on their property tax bills for the service which the county then pays to five haulers with whom it’s contracted.

Robert Mestellar sued the commission saying it’s unlawful to charge for a service the county is not providing, and then put people’s property at risk that don’t pay it.

“No one should lose their home over a stinking trash bill… that’s what the county is doing now and the people have to realize to speak up against this,” he tells WSB’s Sandra Parrish.

Mestellar says the county should get out of the trash business and let people go back to choosing their own haulers.

Frank Jenkins, a Cartersville attorney who is representing the county and the commission, told the court the plan was the best solution commissioners, at the time, could come up with and they had the authority to make the decision.

“You may not particularly like the wisdom or lack of wisdom in some legislative scheme, but it’s up to the local government to determine its most effective and efficient way of providing these services,” he says.
