DEKALB COUNTY, GA — Former DeKalb County Schools Superintendent Devon Horton is set to return to court Wednesday in a domestic violence case as he also awaits trial on federal fraud charges in Illinois.

Horton is scheduled to be arraigned in DeKalb County, where he will formally hear the charges against him and enter a plea.

He faces a three-count indictment, including aggravated assault by strangulation involving his wife. He also faces two counts of third-degree child cruelty because the couple’s children were home at the time of the incident.

Horton’s wife, Christina Horton, told police in January that the strangulation lasted about 10 seconds. During Horton’s bond hearing, she said she was never afraid for her life or the lives of their children.

“Even in the moments that they were escalating I was never fearful for my life,” Christina Horton said.

She also told the court that Horton is not violent and said he had been under stress because of his federal case in Illinois.

“He is not a violent person,” she said.

A judge ordered Horton to have no in-person contact with his wife while on bond and required third-party supervision when he sees their children.

Horton is separately facing a federal case connected to his time as superintendent of the Evanston-Skokie School District in Illinois. Prosecutors allege Horton issued more than $280,000 in contracts to three longtime friends between 2020 and 2023 and received more than $80,000 in kickbacks.

The three other men have also been indicted.

Horton pleaded not guilty to all charges in the federal case last year and resigned as DeKalb County Schools superintendent shortly after the indictment was announced.

His federal trial in Illinois is expected to begin next month. Horton could face more than 10 years in prison if convicted in that case.
