The school alleges Professors Allen and Rina Tannenbaum were getting paid by Tech and an Israeli University at the same time.
An audit by the school questioned more than a dozen trips made by the tenured couple as well as more than $2 million in salaries.
The Tannenbaum's repaid Georgia Tech nearly $80 thousand in travel expenses but maintain they were justified in being paid by Tech and the Israeli University. Their attorney, Buddy Parker, says Tech was not cheated.
Earlier this year another husband and wife team were indicted by a Fulton County grand jury on similar charges of double dipping - earning income from Tech and the University of Minnesota.
"They did their work," he said. "Their work is highly praised by their supervisors and Georgia Tech does not disagree with us on that contention."
