Marietta resident to challenge eminent domain

A case of eminent domain in Marietta may get challenged in court.

Ray Summerour, a lifelong Marietta resident, vows to sue after the city council voted to condemn his property on Allgood Road.  Summerour contends the city has not offered him fair value.

The city of Marietta wants the land to expand the Elizabeth Porter Recreation Center.  The Marietta Daily Journal reports negotiations have been underway for several years.

By moving to condemn the property through eminent domain, the city attorney explains the next step is for a judge to set a price.  Summerour's hired an attorney to challenge the process.
