ATLANTA — Atlanta-based Delta is being sued after a passenger claims he was injured because of the size of the airline’s seats.
Rolondo Jimenez says he was seated next to a larger passenger on a flight from Atlanta to Seattle. He claims he had to contort his body and lean to the left for the entire flight because his seat was broken.
A couple of days later, Jimenez says he was in so much pain that he went to the hospital.
“We realized I had blown my disc in the L3, L4 and I needed emergency back surgery,” he said.
Jimenez is seeking a jury trial and is suing Delta for medical expenses and pain and suffering.
His lawyer says if Delta’s seats were bigger, none of this would have happened.
