The Georgia Supreme Court reins in the Pink Pony in its legal battle with the city of Brookhaven.
The Pink Pony sued the newly incorporated city in 2013, challenging a new city ordinance to ban alcohol sales where there's nude dancing. The club argued the ordinance violates the First Amendment. Attorneys also argued the club predates the city and had a separate agreement with DeKalb County.
A DeKalb judge dismissed the suit. The high court today unanimously upheld that lower court ruling and found no constitutional violation of free speech.
Attorneys for the Pink Pony intend to ask the court to reconsider.
