Ruben Marin-Garibay, facing multiple charges in the wreck that killed Henry County Police Officer Elgin Daniel, has been denied bond due to being a "flight risk."  WSB's Richard Sangster was in court this morning when bond was denied.

Officer Daniel and roadside assistance worker John Cook, 58, were both hit by a Ford truck after they had pulled over to help out a driver who had run out of gas along Hwy 138 in Stockbridge.

Both men were transported to Atlanta Medical Center, where Daniel died from his injuries. Cook’s injuries were non-life threatening.

Daniel worked 26 years with the DeKalb County Police Department and retired as a lieutenant. But he came out of retirement two years ago to work as a Henry County officer, his brother told the AJC.

“We are grieving at the Henry County police department,” Henry County police Major Jason Bolton told News/Talk WSB. “But locating and arresting the individual responsible for Officer Daniel’s death does bring some relief.”

Assistant DeKalb County Police Chief Annette Williams told Channel 2 Action News she graduated from the police academy with Daniel in 1985.

“More than anything, I can say that he loved this job and he was a family man,” said Williams.

Damage to Marin-Garibay Ford truck is consistent with evidence collected at the scene of the collision, Bolton said. He lives about three miles from the crash scene and also owns a custom stone business, according to the Georgia Secretary of State’s Office. Police got a tip about Marin-Garibay and executed a search warrant at his home. His truck was still parked in the driveway of his home when he was arrested, Bolton said.

“I probably got about a half dozen calls from the public and different groups offering additional reward money to help with identifying this individual,” Major Bolton said.

Marin-Garibay was booked into the Henry County Jail late Tuesday.

"He was initially evasive but cooperative," said Bolton. "He did agree to come here to the precinct and give statements."

He is charged with vehicular homicide, serious injury by vehicle, failure to maintain lane, and hit & run.
