Local school districts sued over charter schools amendment

Atlanta —

An Atlanta attorney has filed suit against the state's two largest school districts saying neither is complying with a recent opinion by Georgia Attorney General Sam Olens which states public resources, including websites, cannot be used to oppose the Charter Schools Amendment.

Glenn Delk tells WSB's Sandra Parrish neither Gwinnett nor Fulton Counties have taken any action to curb their opposition.

"We don't believe the Attorney General's opinion has slowed the districts down, and so to enforce the opinion, we've taken this action," he says.

In particular, Delk wants the districts to remove from their websites the section called frequently asked questions which he calls thinly-disguised advertisements against the amendment.

He also wants district PTAs to stop disseminating anti-Amendment literature.

Delk will seek an injunction in Fulton County Superior Court on Wednesday.

"If the judge agrees with us and issues an injunction, and they continue to engage in those activities, they could be held in contempt of court," he says.

Delk says neither Georgia Schools Superintendent John Barge nor the state school board were included in the suit because he says both have complied with the opinion.

Neither school district would comment on the suit when contacted by WSB Radio saying they had not yet seen it.
