LILBURN —
A Gwinnett County man is in jail, accused of shooting and killing a man who pulled into his driveway.
Friends of Rodrigo Abad Diaz say the 22-year-old was trying to get to a friend’s house Saturday night. Instead, his GPS took him to Phillip Walker Sailors’ house on Hillcrest Road in Lilburn.
Sailors came out of his home after the car pulled into the driveway and then went back inside for his gun and shot in the air, Yeson Jimenez, 15, told Channel 2 Action News. Jimenez says he, his brother, and a female were riding in the car with Diaz.
Diaz started to driveway, but Sailors, 69, fired his gun again. This time the bullet hit Diaz in the head, police say.
Sailors, of Lilburn, was arrested Sunday and his charged with murder, according to jail records.
“He is very distraught over the loss of life from the defense of his home,” Sailors’ attorney Michael Puglise said. “This incident happened late in the evening hours when he was home with his wife and he assumed it was a home invasion and he maintains his innocence.”
"We maintain Mr. Sailors' innocence. I can tell you Mr. Sailors certainly thought he was defending his life," sakd Puglise.
An acquaintance of Mr. Sailors' tells WSB his friends rent a home down the street from him and that home was burglarized two weeks ago in which electronics and other items were stolen.
"We all believe that Mr. Sailors was probably upset his property was broken into next door, and then it's 10, 11 o'clock at night and you have a bunch of kids pull up in your driveway. The driveway, it's not just a flat plain and you just pull in the driveway and that's it. You actually have to go down the driveway and by the house. It's kind of secluded, so the story that is coming from the friends of the deceased man does not add up in my mind personally," said Dan Walker.
While the friends claim that they were driving away from Sailors when he fired his gun a second time, Sailors' attorney claims they were actually driving toward him and that forced his client to shoot again.
Sailors remained late Monday in jail, where he was being held without bond. He has no known criminal history.
