(WSB Radio) Despite pleas from residents in surrounding neighborhoods, the Snellville City Council says it has no legal way to stop the owner of the Cremation Society of the South from opening a crematory on property along Highway 78.

At a standing room only meeting Monday night, City Manager Russell Treadway told citizens and the City Council that a just complete environmental impact study showed no hard evidence that crematories are dangerous.

The Council did approve a new ordinance that will allow city employees to regulate business emissions, but Mayor Jerry Oberholtzer said he doesn't believe the measure will stand up to a legal challenge.

With state permits and licenses in hand, crematory owner Chris Nuzum can now apply for a business license from the city of Snellville and a certificate of occupancy. Nuzum says he will file suit against the city if they do not allow him to open the business.
